UK Pensioners and Right to Work: Understanding Your Immigration Status

Many individuals who settled in the UK decades ago, particularly pensioners, might find themselves in a unique situation when it comes to proving their right to work or even their general immigration status in today's digital age. We, as UK Immigration Lawyers, frequently receive queries from individuals who arrived in the UK many years ago with "indefinite leave to enter" and are now being asked for updated proof of their status.

Let's delve into a common scenario: you arrived in the UK in the 1970s with indefinite leave to enter, have lived here ever since, and are now a pensioner. If you decide to work a few hours to supplement your income, your employer might request proof of your right to work, specifically asking for biometrics. Is this right? And what exactly does it mean for you?

Your Indefinite Leave to Enter from Decades Ago

If you were granted indefinite leave to enter the UK in, for example, 1975, this status remains valid. Your proof of this would typically be an endorsement (a stamp or vignette) in your passport from that time, or an official Immigration Status Document. This historical grant means you have the right to live and work in the UK without time limits.

The Shift to Digital and Biometrics

The UK Home Office is progressively moving towards a fully digital immigration system. This means that many people will soon prove their immigration status through an online record (an eVisa) and a share code, rather than physical documents.

To facilitate this transition, and to ensure everyone has a readily verifiable digital record of their status, individuals who hold indefinite leave but do not have a Biometric Residence Permit (BRP) or a UKVI online account are encouraged to apply for a "No Time Limit (NTL)" document.

What is a "No Time Limit (NTL)" Application?

An NTL application isn't about applying for new leave to remain; it's about confirming your existing indefinite leave status and having it officially linked to a modern digital record. During this application process, you will provide your biometrics (fingerprints and a digital photograph). Once your NTL application is approved, you will receive an eVisa, which is an online record of your immigration status.

Why Your Employer Might Ask for Biometrics

Employers in the UK have a legal obligation to conduct right to work checks on all their employees. In the past, this might have involved simply inspecting a passport with an indefinite leave stamp. However, with the push towards digital verification, employers are increasingly seeking a more robust and easily verifiable method.

When an employer asks for biometrics, it's often because they are looking for a current and digitally accessible way to confirm your right to work. An NTL application, which involves providing biometrics, will ultimately provide you with that very proof in the form of an eVisa and a share code, making the right to work check process straightforward for both you and your employer.

What This Means for You

If you are a pensioner with indefinite leave from many years ago and are facing similar requests, applying for a No Time Limit (NTL) document is often the most practical solution. It streamlines the process of proving your existing immigration status and ensures you have an up-to-date, digitally verifiable record.

We, as UK Immigration Lawyers, can assist you with understanding your specific situation and guide you through the NTL application process.
