The Unmarried Partner Visa is a vital route for couples who are in a relationship akin to marriage or civil partnership but have chosen not to formalise their union. It allows one partner to join the other in the UK, eventually leading to Indefinite Leave to Remain (ILR), often referred to as "permanent residency."

Key Requirements to Consider:

  • Genuine and Subsisting Relationship: This is the bedrock of your application. You must prove your relationship is real, ongoing, and committed.

  • Relationship Duration: Typically, you need to have been in a relationship similar to marriage or civil partnership for at least two years.

  • Financial Requirement: Your UK-based partner (or both of you jointly) must meet a specific income threshold to show you can be supported without recourse to public funds.

  • English Language Requirement: You'll need to demonstrate a certain level of English proficiency.

  • Intention to Live Together Permanently: This is where the cohabitation aspect becomes central.

Cohabitation: Do We Have to Live Together Immediately, and What if We Can't?

Historically, the Unmarried Partner Visa had a very strict requirement for two years of physical cohabitation before the initial application. However, important changes to the Immigration Rules from 31 January 2024 have brought a more nuanced approach.

The strict two-year cohabitation requirement has been removed from the definition of a "partner." This means that while demonstrating a genuine and subsisting relationship for two years is still crucial, the Home Office now recognises that compelling reasons might lead to periods of non-cohabitation within that two-year period, or even immediately after the visa is granted.

What if my partner has a temporary job elsewhere, and we can't cohabit straight away after the visa is granted (like Fatemeh's concern about a job in Dorchester while she's in London)?

The Home Office understands that life circumstances, such as employment opportunities, can sometimes necessitate temporary periods of living apart. The key is that you must still demonstrate a clear and credible intention to live together permanently in the UK.

How to Address This in Your Application:

  1. Transparent Explanation: Provide a detailed, credible explanation for why immediate cohabitation isn't possible. For instance, if your partner has a temporary job, explain its duration and your mutual plans for when that changes.

  2. Robust Evidence of an Ongoing Relationship (Despite Distance):

    • Consistent Communication: Include extensive proof of your daily contact: phone records, messaging apps (WhatsApp, Skype), emails, etc.

    • Regular Visits: Show travel tickets, hotel bookings, and photos from your trips to visit each other or shared holidays. This demonstrates active engagement in your relationship.

    • Shared Responsibilities/Finances (if applicable): While challenging when apart, any joint financial accounts, shared bills, or evidence of mutual support can be valuable.

    • Letters from Loved Ones: Secure supporting letters from friends and family who can attest to the genuine, committed nature of your relationship, despite the geographical challenges.

    • Future Plans: Demonstrate your joint intention and steps being taken to establish a shared home – this could include job searches in a common location, or discussions about future living arrangements.

  3. Clear Plan for Cohabitation: Outline when and how you intend to establish a shared home in the UK. This plan should be realistic and supported by any relevant documents (e.g., job offers, property searches).

Does Time on the Unmarried Partner Visa Count Towards Settlement?

Yes, absolutely! The time you spend in the UK on a valid Unmarried Partner Visa typically counts directly towards your Indefinite Leave to Remain (ILR), or permanent residency.

The most common route is the 5-year route. This means that if you meet all the requirements throughout your visa period (including financial, English language, continued demonstration of a genuine relationship, and ongoing cohabitation where expected), you can apply for ILR after completing 5 continuous years in the UK on this visa.

Can You Get Permanent Residency If You Remain Unmarried After 5 Years?

Yes, you can! The Unmarried Partner Visa route is specifically designed for long-term relationships where the couple has chosen not to marry or enter a civil partnership. Marriage is not a requirement to obtain ILR if you are on the Unmarried Partner route. As long as you continue to meet all the eligibility criteria throughout your 5-year period (including the genuine and subsisting relationship, financial requirements, English language, and passing the Life in the UK Test), you can secure your permanent residency.
