Yes, you can sponsor a family member to work for your business as a Tier 2 (General) visa holder.
For job roles starting on or before 31 December 2020, you will have to do a Resident Labour Market Test (RLMT) in the UK, i.e. advertise the position in the UK for at least 28 days and consider and interview any candidates that apply, it is suggested that the related family member does not get involved in the RLMT, unless it is not possible. (RLMT will not be required from 1 January 2021 under the new Immigration rules after Brexit transition period has ended)
In the first instance, the Home Office usually would think that it is just an attempt to bring the family member to the UK, however, in order to prove it otherwise, the RLMT must be conducted genuinely and all records kept. The family member should usually not be involved in the interview process of candidates or in shortlisting resumes
Also, please note that the Level 1 one user who assigns the Certificate of Sponsorship(CoS) to the proposed employee (family member) should be someone other than the family member working in the business, for example, Level 1 user can be either an Human Resource employee or even your Legal Representative, if they are the Key Contact on your Sponsor Licence application.
Further, after assigning the CoS and making payment for the CoS, the Level 1 user who assigned the CoS should also put a note in the Sponsor Note column about the relationship between the proposed migrant employee and the business owner or employer.
When filing the Tier 2 application, it is advisable to submit copies of all the documents to show that the family member was the most suitable person for the job role, for example, the Resume / CV detailing the education and experience of the family member, educational certificates, any specific skills required for the job role.
Usually, it is not very easy to get a Family Member sponsored for a Work visa such as Tier 2 (General), however, if there is a genuine vacancy and the family member is the right candidate, then it would work.
